Terms for advertisers

1. What we offer

A listing on rosalon is free of charge during the launch phase. We show your profile in the directory and in the search; anyone searching on rosalon also finds it via your display name.

We do nothing more: we do not arrange meetings, accept no bookings and no commission, and handle no money between you and your clients. We have no share in your earnings.

If a listing is to cost something later, we will tell you in advance. Without your consent, the free listing will not become a paid one.

In addition, we offer paid services as soon as we open them; we announce this on this page and by email. They are featured placement above the list of results, house presence, room offers and market reports. What applies to them is set out under “Prices and payment” and in the sections on each of these services. Nothing changes for the free listing.

2. You decide

What you offer, at what price, and when, where and with whom you meet is for you alone to decide. We impose no requirements on you in this respect: no minimum or maximum prices, no obligation to be reachable, no exclusivity. You may advertise on other portals at the same time.

The badge does not secure a better position in the search, and a profile without a badge is not placed further down.

Profiles on rosalon appear in the search ahead of entries from other portals if they match the filters set, and for this reason visibly carry the mark “Direct on rosalon”. Among themselves, the same order applies to all profiles: first the day of publication or last change, then a new random draw every day. In the price comparison only the price counts; only at the same price does your profile appear ahead of a third-party entry.

The order of the list cannot be bought, and how often a profile is clicked plays no part in it. Above the list, a provider can – as soon as we open paid offers – have their profile featured for one to four weeks: at the same price as everyone else, visibly labelled “Featured · paid”, at most three per canton and category (see “Featured placement”).

3. At least 18 years old

Only persons who are at least 18 years old may advertise. By accepting these terms you confirm this. Anyone who can be seen or is described on your profile must also be at least 18 years old. If you create a profile for another person, that person confirms this themselves, through their own link; your confirmation is not enough for this.

No picture and no information on your profile may suggest that someone is younger. You may use a word such as “Teeny” in your display name or in a title – but your profile will then only appear once we have checked your ID and seen in doing so that you are at least 18.

4. ID and badge

You can advertise without an ID. Before your profile appears for the first time, we check your phone number, and for services in return for payment you confirm that you are at least 18. A moderator from our team looks at your profile with its pictures and approves or rejects it; you can then improve it and submit it again.

The ID verification is voluntary – unless your display name or a title contains a word such as “Teeny”: it is then a condition before your profile appears (see “At least 18 years old”). If you do it, your profile receives the badge. For this you send us a picture in which you hold your ID next to your face; we compare it by hand with your profile pictures. The picture is kept with us in encrypted form until the decision, at most three days, and is deleted afterwards; all that remains stored is when and how the verification was carried out. Details are set out in the privacy policy.

We may require an ID verification before a profile appears or appears again – for instance after a report of suspected minority or if we have doubts about the age. Until then the profile remains hidden.

5. Your details, no one else’s photos

You advertise for yourself, with your own details – or for another person, in which case under the “terms for representatives” below. An account keeps up to five profiles. If you tick “I act as an intermediary for others” on your account page, there is no upper limit; each profile is still checked individually. You can remove the tick again as soon as your account keeps no more than five profiles and none of them is for another person.

No one else’s photos. Only upload pictures that show you or that you took yourself and to which you hold the rights. If anyone else is recognisable in them, you need that person’s consent, and they must be at least 18 years old. Pictures from the internet, from other profiles or from a photographer without their permission do not belong on rosalon.

Which pictures may appear on a profile: Nude pictures yes, including revealing ones, but no depiction of sexual acts. Before your profile appears for the first time, we look at it with all its pictures; pictures you upload after that appear without a new check, unless we hold one back for checking. If a picture shows neither genitals nor sexual acts – for example clothed, in lingerie, including see-through, or from behind –, we can rate it as fine to show openly. It then appears without an age check on your profile and as a small preview in the search, visible to everyone, and search engines may index it. Every other picture stays behind the age check, including every picture we have not yet rated. Your tile in the search shows your cover photo if it is rated fine to show openly, otherwise the first picture of your profile that is fine to show openly. We can check and remove any picture at any time.

If you import a listing from another portal, it may only be your own. An imported profile appears after 48 hours at the earliest, and until we have checked it, a single report is enough to take it offline.

Your details must be accurate: services, prices, place and pictures as you really offer them. The prices are your statement, not ours.

6. Listings for others: terms for representatives

This section applies in addition if you create a profile on rosalon for another person – as a manager, as an agency or as a house that advertises for the people who work there. A house that advertises in this way counts as a representative like any other.

Before you advertise for others, you give your name or your company’s name and a phone number at which we can reach you; your company’s UID is optional. We do not check these details in advance and do not show them publicly. And you expressly accept this section.

You act on the instructions of the person whose profile you create. You are responsible for everything you enter – pictures, texts, prices, services, place and contact options – as if you had entered it for yourself, and you indemnify rosalon against any claims arising from it. The person themselves is responsible only for what they confirm through their own link: that they are at least 18 years old and agree to the profile. You only upload pictures that show this person and that they have released for this purpose.

Each person confirms for themselves. For each profile you generate a separate link and pass it on to them; it works once and for at most seven days, and a new link makes the old one invalid. On the page behind it, they see their profile in their language, can untick services, confirm that they are at least 18 years old and give their consent – or say no. Only after that do we check the profile, and only after that can it appear. You may not confirm in their place: if you open the link in a browser in which you are signed in with us, we accept no confirmation. We record when they confirmed, to which wording and in which language.

The person can switch off or delete their profile at any time, without asking you and without you being able to undo it: with their own code, which they receive when confirming, or with the button “This is me – please remove it” on every profile page, without an account and without a code. With the button, the profile disappears immediately until we have looked into the matter. Afterwards you see that the profile no longer appears, but not by which route.

You do not create a profile for a person under 18 years of age, for a person who knows nothing about it or does not want it, or for anyone whose offer, prices or earnings you decide against their will. You do not take the link or the code away from them, and you confirm nothing for them.

We do not limit how many profiles you manage in this way. If something about an account catches our attention, we hold back profiles until we have checked them, and we may call you. In the event of suspected minority, coercion or a false identity, we block your account and may report the matter to an authority or a specialist service.

For each profile you see the same figures as the person themselves: views and clicks on the contact options, per day. The profile does not publicly show that you manage it.

As soon as we open paid offers, the following applies: whatever you order for a profile you run for another person, you pay for, and the invoice and receipt are made out to you. A featured placement for such a profile only comes about if the person agrees to it via their own access. There they see every featured placement of their profile and can end it at any time without asking you. If they end a featured placement that is already running, you get no money back for it (see “Refunds and the end of an order”).

7. What does not belong on rosalon

• persons under 18 years of age, and any indication of this;
• profiles that someone creates for another person without that person’s own confirmation, and profiles where someone decides on the offer, price or earnings against the person’s will;
• names, pictures, numbers or other details of people without their consent;
• offers in which someone is forced into something;
• non-consensual violence, animals, and content prohibited by criminal law;
• bait prices and information that is not accurate.

8. Rights to your texts and pictures

Your texts and pictures remain yours. You grant us the right to show them on rosalon, to process them technically for this purpose (re-encode, downscale, remove metadata), to machine-translate title and description into German, French, Italian and English and to show the translation next to your original – as long as you do not switch this off in your profile – and to make your profile, together with the pictures rated fine to show openly, accessible to search engines for as long as it exists. We do not sell them and do not pass them on.

If you delete them, this right ends. What search engines have already copied, we cannot retrieve.

9. Checking, hiding, blocking

We look at every profile before it appears for the first time. Changes and new pictures after that appear without a new check, even if you make your profile visible again after a pause – unless we hold back an individual picture for checking. We can check everything at any time. Every picture that appears without an age check – on your profile, in the search or as the cover photo – has first been looked at by someone from our side and rated fine to show openly.

We may hide or delete profiles, texts and pictures if they breach these terms or the law, or if a report is received. If there is a report, we first take the profile offline and then check – unless the report concerns coercion, fraud or a business posing as private, or it states “Other reason”: then we look first, and your profile remains visible until we have decided. A decision is made within 48 hours. You can see the status of your profile in the advertiser area.

In the event of a serious breach – suspected minority, coercion or a false identity – we may block your account and report the matter to an authority or a specialist service.

10. The reporting channel protects you too

Anyone can report a profile via the reporting channel, without an account. If someone creates a profile with your name, your number or your pictures, press “This is me – please remove it” on the profile page: it disappears immediately until we have decided.

11. Pausing and deleting

You can pause your profile at any time – it is then not visible – or delete it yourself, immediately and without further questions; the same applies to your entire account. Together with the profile, its texts, prices, pictures and verification notes disappear, and its address then reports that the profile no longer exists.

What search engines have already copied, we cannot delete. A switch with which you can block your profile for search engines does not exist yet.

12. No guarantee of reach

We promise no particular number of views or contacts, nor that the site will always be available. We are not responsible for what happens between you and your clients.

To the extent permitted by law, we are liable only for damage that we cause intentionally or through gross negligence.

13. Your obligations towards the canton and the municipality

Your activity is subject to the rules of your canton and your municipality, such as registration requirements. Complying with these rules is your responsibility; we do not check this and do not advise you on it. The specialist services in your canton can help you further.

14. Room offers

You list only rooms that you rent out yourself, and no information about persons who work there. Enquiries reach you via our contact form at the address you provide for this purpose; it is not published.

You are yourself responsible for complying with what your canton and your municipality require for renting out such rooms, such as a notification or a permit; our reference to this is not advice on the law.

We check every offer before it appears, and again if you change the type, municipality, description or the address for enquiries; you can change the rent and “free from” without a new check. We may reject an offer.

Each time you submit an offer for checking, you accept these terms; we store with the offer which version you accepted and when.

The tick “I want to rent out rooms” on your account page grants exactly this one right: to list rooms. It does not come with a listing for you or a house. And anyone who rents out rooms does not review houses.

As soon as we open paid offers, renting out rooms costs a subscription per account and month, paid in advance. It covers up to three offers; each additional offer costs extra. The prices are on the “Prices” page. This applies from the moment we open paid offers, including to offers that are already showing at that point; there is no further notice period. If a month is not paid, your offer is invisible but not deleted; once paid, it reappears.

15. Prices and payment

Paid offers exist only once we open them; we announce this on this page and by email. From then on, the following applies to everything you order from us:

• The prices are on the “Prices” page and shown with every order, in Swiss francs and including any VAT. The price of your order is on its invoice and does not change afterwards. If we change a price, the new one applies only to new orders.
• You pay in advance, for the term you choose when ordering. Nothing renews by itself: before a term ends we remind you, and it only continues if you order again.
• You pay with a QR-bill, in e-banking or in the TWINT app. Invoice and receipt are in your account; what they show and what they do not is set out in the privacy policy.
• We activate as soon as your payment has reached us. If you have already paid an earlier order in full and none of your invoices is overdue, we activate immediately, and you have 10 days to pay. If the invoice remains unpaid, we pause the service once this period has expired; for your next orders the rule is then again: only after payment has been received.
• A featured placement is never activated before your payment has reached us.
• We do not collect an unpaid invoice and charge no reminder fee; if you do not pay, the order lapses.
• We keep no credit balance, and there are no credit notes. If you pay too much or twice, we transfer the amount back to you, to the account you give us for this purpose.
• Profiles located in the cantons of Vaud, Geneva, Neuchâtel and Valais remain free of charge until further notice and cannot book a featured placement.

16. Featured placement

As soon as we open paid offers, you can have a profile featured. It then appears in a separate band above the list of search results, labelled “Featured · paid”. The band appears only there, not on other pages. The list below stays as it is: the same order as without the band, and your profile also appears there in its usual place.

A band applies to one canton and one category and has at most three places. If all are taken, you go on a waiting list, in the order in which orders were received. The order within the band is drawn anew on every page view, so that every featured profile is at the top equally often.

You book whole weeks, one to four in a row. So that nobody occupies a place permanently: if someone is waiting for a place in your band, after two weeks you can only book again after a one-week break.

The price is the same for everyone, with no discount and no bidding; it is on the “Prices” page. A place in the band is only available against payment – free for no one, not even for ourselves. Whether your profile has a badge, how it is rated or how often it is clicked plays no part in this.

Your profile appears in the band only if it meets the filters of the search in question. If it is paused or blocked, it does not appear; the booked time keeps running (see “Refunds and the end of an order”). We promise no number of views or contacts.

Profiles located in the cantons of Vaud, Geneva, Neuchâtel and Valais cannot book a featured placement until further notice. If you run a profile as a representative, a featured placement only comes about with the consent of the person, given via their own access (see “Listings for others: terms for representatives”).

17. House presence

The page of a house that we keep from public information remains free of charge and public, whether the house pays anything or not.

As soon as we open paid offers, you can book house presence for your house, payable monthly in advance, if we have assigned your account to that house. It includes: maintaining pictures, text and price list yourself; showing the women who work there and have given their own consent; listing events; seeing the figures for your own house page; and the market report for your own canton.

Whatever of this you already use today without paying is available only with the house presence from the moment we open paid offers; there is no further notice period. If a month is not paid, the paid parts fall away; the page of the house remains as we keep it from public information.

18. Market reports

As soon as we open paid offers, we sell market reports for businesses: figures on supply, prices and demand in a canton, per quarter.

A report contains only figures. Each figure is based on at least five listings; it never contains the name or number of a person, nor any single listing. Demand means totals of the searches on rosalon: by canton, category and service, and typed search terms that correspond to a service, a place, a characteristic or a house listed with us, as monthly totals from five searches upwards. These figures show what our visitors search for, not the whole market.

Each report bears the date of its status. It is based on what was publicly visible and what we were able to record; it is not complete, and we give no guarantee that it is, or that every figure is correct.

You may use the report within your business and quote individual figures from it if you name rosalon as the source. You do not pass on or publish the whole report or large parts of it.

With an account you see the report in your account and can print it. Without an account you order with an email address: you receive a QR-bill, and once payment has been received we send you a link to the report that expires after a set period; we do not send a file. We delete your email address after delivery or, if the order lapses unpaid, at that point.

19. Refunds and the end of an order

Before you have paid, you can withdraw an order at any time; it then costs you nothing, and a service already activated ends.

If the service you paid for never appears – for example because we do not approve your profile, because there is no free place left in the band, or because the person whose profile you run does not agree to the featured placement or ends it before it has begun –, you get the full amount back.

If we block your profile, your account or an offer wrongly, or if we discontinue rosalon or a service, you get back the part that falls on the time after that. If we block because of a breach of these terms or of the law, nothing is refunded.

If you pause or delete yourself before the end of the term, nothing is refunded; the paid time keeps running during a pause.

For a featured placement that is already running there is a refund only if we have made a mistake – for example if the band did not appear for more than 24 hours or we wrongly blocked your profile –, and then for the time lost. If the person whose profile you run ends a running featured placement in their own access, there is no refund.

Whatever we refund, we transfer within 30 days to the account you give us for this purpose.

20. End of the contract

You can stop at any time by deleting your account. We may terminate the contract and delete your account if you breach these terms, or with a notice period of 30 days if we discontinue rosalon.

If you do not pay for a service, we pause it instead of deleting anything: your profile, your house details or your room offer remain stored and reappear as soon as payment has been made. The same applies if the launch phase ends and you do not agree to the price for your listing: we then pause your profile instead of deleting it.

21. Changes

If we change these terms materially, we will ask you again before you next edit your profile. We store which version you accepted and when.

22. Governing law and place of jurisdiction

Swiss law applies. Jurisdiction is governed by the statutory rules; in contracts with consumers, these cannot be departed from in advance.
